Police arrested businessmen for permitting customers to enter stores without masks

Some citizens, including entrepreneurs, have not been able to adapt to modern realities and restrictions.

During the quarantine period, strict measures are taken against entrepreneurs who have not fulfilled the requirements of the authorities. Ombudsman for the Protection of the Rights of Entrepreneurs of Kazakhstan Rustam Zhursunov addressed the Chairman of the Supreme Court and the Minister of Internal Affairs of the Republic of Kazakhstan with this problem, zakon.kz reports.

Due to the seriousness of the problem of coronavirus infection, strict restrictive and quarantine measures have been introduced everywhere in Kazakhstan. However, some citizens, including entrepreneurs, have managed to adapt to modern realities and restrictions.

“In this regard, violations related to the emergency and quarantine regimes are often tolerated, in particular, in the following cases. 6) Article 476 of the Code of Administrative Offences - a violation of the regime or failure to comply with the requirements established by the state authority in connection with the declaration of a state of emergency in terms of quarantine and other mandatory sanitary and epidemiological measures. Sanctions of this article provide for a warning or a fine in the amount of 10 MCIs or administrative arrest for up to 15 days,” he said in his letter.

Businessmen from Northern Kazakhstan are also among those who have committed offences. Thus, after the announcement of restrictive measures, individual entrepreneurs of Petropavlovsk Bimberin N.P. and Ulman N.V. for permitting customers to enter stores without masks and did not provide them with free means of protection.

Also, another obligation was not fulfilled - distribution of leaflets on coronavirus prevention. For these offences against two businessmen, the specialized administrative court of Petropavlovsk made a decision - arrest for 5 days.

According to Rustam Zhursunov, arresting entrepreneurs aggravates the impact of already existing restrictive measures and negatively affects the economic and social situation.

“It's not easy to keep their business now. In addition, detention creates the conditions for many people to come into contact, which contributes to the active spread of coronavirus infection. Taking into account all these circumstances, I sent letters to the Chairman of the Supreme Court and the Minister of Internal Affairs of the Republic of Kazakhstan with a request to minimize the use of arrest in respect of entrepreneurs who have committed formal violations of the state of emergency, and apply penalties in the form of a warning and a fine of 10 MCI,” Rustam Zhursunov said.

The same strict measures were taken against businessmen of the Akmola and Mangistau regions. It should be noted that 59% of the total number of citizens of Kazakhstan (1,268 people) were fined and 37% arrested. Only 4% of the offenders received warnings.
